BUYER'S AGENT OR SELLER'S SUBAGENT WHICH IS RIGHT FOR YOU?
In helping you locate the property you want and going through the purchase process, to closing, we can work with you as either a Sub Agent of the Seller or as a Buyer's Agent. In the State of North Carolina, agency is not determined by who pays our commission, but rather to whom we have fiduciary responsibility.
As A Buyer's Agent
  • We are working for the buyer and owe the buyer fiduciary responsibility.

  • We are obligated to learn as much as possible about the property and disclose anything we can find out about the property other than legally restricted items.

  • We must disclose to the listing office that we are a Buyer's Agent at first contact with them.

  • In most cases our commission will be paid by the Seller as part of the total selling commission split

  • In cases where the Seller has not authorized a Buyer's Agent to be paid from the commission the Seller is paying, thus obligating you to pay the commission, you will be informed of that before making an offer. The MLS sheet reveals the commission authorization information.

  • You are obligated to work exclusively through us for any property purchase during the contract period. This would include property you saw that was for sale by another agency or as for sale by owner.

  • Dual Agency is a possibility that we will discuss that with you as necessary.

  • The choice is yours; however, I recommend you consider working with a Buyer's Agent.

As A Seller's Sub Agent
  • We are working for the seller's best interest to obtain the best price for the seller that we can

  • We cannot provide any information (other than that which is material to the property) which would be disadvantageous to the seller.

  • Regardless of the seller's desires to the contrary, we must provide any information that is material to the property and would affect the value of the property to you.

  • We can provide public information (such as tax valuation) if requested.

  • We cannot give offering price or negotiating advice.

  • We will not reveal information about the length of time the property has been listed.

  • You may work with other Realtors at the same time.
